All contractors (private, public or both) must register with the State of Delaware by August 1, 2021 in order to do any business in the state of Delaware. The implementation of the legislation was delayed due to COVID-19 but is set to go into effect on August 1, 2021.
The registration fees are earmarked to ramp up enforcement of employment laws in Delaware to ensure a level playing field in construction. Of note is the broad definition of a “Contractor” as it includes anyone engaged in the business of furnishing labor or both labor and materials to any size project.
