The 5th US Circuit Court of Appeals has put a temporary halt on OSHA’s COVID-19 Vaccination & Testing Emergency Temporary Standard.
OSHA is currently barred from both enforcing or implementing the ETS. The December 6 and January 4 deadlines are also on hold.
Some legal experts recommend that employers prepare to comply while the ETS is in litigation in case the stay is removed and the ETS is implemented and enforced. Other legal experts recommend waiting.
Employers should consult with their legal counsel to determine their course of action.
