UPDATED November 9, 2021 with AGC’s Summary of OSHA’s COVID-19 Vaccination & Testing ETS.

On November 4, 2021, the U.S. Department of Labor’s (DOL) Occupational Safety and Health Administration (OSHA) announced an Emergency Temporary Standard (ETS) to minimize the risk of COVID-19 transmission in the workplace. The ETS establishes binding requirements to protect employees of large employers (100 or more employees) from the risk of contracting COVID-19 in the workplace.

 

The ETS is currently up for public inspection (Comments close on January 6, 2022).

 

OSHA has updated its website with access to the regulatory text, fact sheets, sample policies, and links to related Department of Labor (DOL) and Centers for Disease Control and Prevention (CDC) resources.

Submit comments at www.regulations.gov, the Federal e-Rulemaking Portal, and refer to Docket No. OSHA-2021-0007. All comments must be submitted by 30 days after publication in the Federal Register.
